The trouble with electing judges
BACK in 1996, William Rehnquist, then chief justice of the Supreme Court, called an independent
judiciary “one of the crown jewels of our system of government”. He considered America’s courts a model
for other countries. Would-be foreign imitators might, however, consider Caperton v Massey, a case that
the Supreme Court will hear on March 3rd. In 2004 Don Blankenship, the chief executive of Massey
Energy, spent $3m to help elect Brent Benjamin to West Virginia’s Supreme Court. In 2007 Mr Benjamin
voted to overturn a $50m judgment against Massey.
With Caperton v Massey, the Supreme Court will consider the effect of campaign spending on the
judiciary. Thirty-nine states hold judicial elections. The fights are bitter, part of an escalating war
between business groups and trial lawyers. From 2000 to 2007 fund-raising for state Supreme Court
races reached $168m, almost twice the amount raised in the 1990s.
The main question is whether Mr Benjamin’s failure to recuse himself denied a fair trial for Hugh
Caperton, whose coal company Massey had allegedly bankrupted through fraud. Rules for recusal do
exist. The Supreme Court has warned against a “probability of unfairness”, but its most definitive ruling
only bars judges from cases in which they have a financial stake. Forty-seven states have adopted the
American Bar Association’s tougher rule for recusal when “impartiality might reasonably be questioned”.
But most judges are responsible for recusing themselves. Mr Benjamin thought it unnecessary.
Mr Caperton’s lawyers argue that the nature of Mr Blankenship’s spending, including its scale (60% of all
the money raised for Mr Benjamin) and timing (Massey was preparing an appeal), created a
“constitutionally unacceptable probability of bias”. Mr Benjamin may, of course, have been truly
impartial. But one poll found that 67% of West Virginians doubted it. Mr Caperton’s cause has a wide
range of supporters, from the Brennan Centre in New York to more unusual suspects,cheap uggs, such as the

Reformers should temper their excitement. First,ugg store, Mr Caperton may not win. Mr Blankenship was not,
personally, a litigant and has done nothing illegal. He gave only $1,000 directly to Mr Benjamin’s

I had uggs ordered from me for my birthday from 511. they have not come yet, so i can’t comment on them, but i am so concerned at this point that they are fake. since they were a gift, i feel sick to my stomach that my family got ripped off trying to make me happy. are we sure that these are not real uggs? I”m still holding out hope that possibly they have just been gotten in a foreign market at a cheap price, but are still real uggs?

I also ordered 2 pair of uggs at 511stores. I’m living in Holland and I didn’t receive them. The Belgian custums destroyed them because they are fake. I also thought that they were real. When I told 511stores that they have to sent me new ones or I would get my money back they promised me to sent new ones.In the meantime I spoke with Visa and they got my money back. If I didn’t new it were fake boots that was my right. So I’ve got the money back, also the shipping fee.Today I’ve got a letter from an attorney in Belgium that they want ?250,00 because I ordered fake uggs. So it’s not over yet.
I don’t think you want to order your boots there anymore.

I just received my boots after ordering them three weeks ago from 511stores.com. They are the wrong color (ordered the Cardi Ugg). After reading all of the posts and seeing the package came from CHINA, I am pretty sure I got taken advantage of. Does anyone have their costumer service number? They encourage customers to call their costumer service hotline, but none is given. Why didn’t I notice this when I was ordering?! Sent an email to the two emails given, but I doubt I will hear anything. What do I do?? So frustrating…

I have red that China made Uggs are fake. I got my Uggs from 511stores and the label inside said: made in China.
I am also having the same problem as many here – I ordered a pair but got the wrong size. After mailing back and forth I finally got an adress where I could return them. But of course I have not got the new ones in correct size. I have also been mailing to this Jevons. God I hate him!!! Has anyone succeeded getting money back from their credit card company? Due to the popularity of last week’s post on cheap Ugg boots, I can’t hold on to this one.

Bethany, I did wonder about the China overstock reference on the site, but then I looked around a bit and couldn’t find anything negative about 511 stores. That doesn’t mean, though, there may not be a problem and you bring up a good point about doing your research before clicking “place order.”

Don’t order at 511stores.com. The boots are FAKE and they doesn’t want return money. Also I received dirty ones. I have to admit, they made them almost like real ones (I also have real ones). But I don’t want to wear fakes ones. I’ve asked the several times if the boots are real and they admit, so now i’m in the discussion with Visa and 2 other companies to get my money back!

Anna, I unfortunetly ordered from 511stores.com too. My shipment hasn’t come yet but I know that they’re fake. Did you happen to try to contact them and try to return the fake UGGs? Was there even like a legit return address on the package?

I bought from 511stores and my uggs are fine! I dont think theyr fake.. So im happy:D

511stores.com is offering as much as 50 percent off Ugg boots. While that may not be quite the steep discount we saw last week, this one doesn’t have a deadline.

I ordered Uggs from 511 stores and i received the wrong size. I went to the actual Ugg store in NYC to exhange them and they confirmed that are FAKE. I am now going back and forth in emails with 511 about returning them because they clearly do not want to give refunds. When they asked me why i want to return the boots, i explained i was sent the wrong size and that Ugg confirmed they were knock offs. They are still claiming that they are real and supplied from Youfromugg factory. I don’t know what that is, but i want a refund. For those of you who have spoken to your credit card companies, do they seem helpful?

DO NOT BUY UGG BOOTS OFF HERE ! Not only are they fake they are not real sheep skin and when i asked for a return they asked me for $60 for shipping ! this website should be shut down as i thought i was buying real ugg boots but they are 100% FAKE !! and they are the worst copy ever and they took 3 weeks to come ! please if any one want to buy ugg boots dont buy them from 511 stores !!!!!!!

new ugg for coming Fall. i am searching my footwear as well. Never forget the shining way wearing UGG boot last year. i got on a local ugg outlet which site i remember is http://www.uggkings.com. The price there is increasing this year. Still, better than that site. Yo u can also spend high cost on http://www.6pm.com
